This report by the Family Law Council (FLC) details its recommendations and general discussion around the issue of sterilisation (which most commonly involves young women with intellectual disabilities - the gender dimension of the issue also needing to be taken into account) to the Attorney General. The FLC recommends (among other things) that there should be a new division within the Family Law Act regulating sterilisation of young people and that sterilisation could never be authorised under this new division for eugenic reasons, for purely contraceptive purposes, as a means of masking or avoiding the consequences of sexual abuse, or prior to the onset of menstruation. The report continues with a discussion around the terms of reference - mostly legal - but these legal issues, however, raised fundamental ethical and social issues which the report also details.
